1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Lumen, a conversational business intelligence platform operated by Ocularity Analytics Private Limited ("Ocularity Analytics", "we", "us", or "our"). By creating an account or using Lumen in any way, you agree to be bound by these Terms. If you do not agree, do not use Lumen.

You must be at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or the business you represent.

2. The Service

Lumen is a software-as-a-service platform that connects to third-party business tools (including Shopify, Meta, Google, Razorpay, Shiprocket, and others) via authorised integrations, and provides a natural language interface to query and understand your business data.

You are responsible for maintaining the security of your account credentials. You must provide accurate and complete information during registration. One account may be associated with one brand. If you discover unauthorised access to your account, notify us immediately at lumen@ocularityanalytics.com.

We reserve the right to terminate accounts that violate these Terms, that are found to be providing false information, or that have been inactive for more than 12 consecutive months on the Free plan.

4. Subscription and Billing

Lumen offers the following plans:

Token top-up packs are available as one-time purchases on both Free and Pro plans. All prices are in Indian Rupees and are inclusive of applicable taxes unless stated otherwise.

Subscriptions renew automatically at the end of each monthly billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for the current billing period on cancellation. For full refund terms, see our Refund and Cancellation Policy.

All payments are processed by Razorpay. By making a payment through Lumen, you agree to Razorpay’s terms of service.

5. Tokens and Usage

Lumen uses a token-based system to measure usage. One token corresponds to one unit of text processed by the AI system (approximately one word). Token allocations reset at the start of each monthly billing period. Top-up tokens do not expire and are consumed after your monthly allocation is exhausted.

Query counts described in our marketing materials are estimates only. Actual token consumption varies based on the complexity of questions and the volume of data queried. We always precede query count estimates with "approximately" and we never guarantee a fixed number of queries from any token allocation.

7. Third-Party Integrations

Lumen connects to third-party platforms (Shopify, Meta, Google, Razorpay, Shiprocket, and others) via OAuth and API integrations. By connecting a platform, you authorise Lumen to read data from that platform on your behalf. You remain responsible for your compliance with each platform’s own terms of service.

Lumen does not write to, modify, or delete data on any connected platform unless explicitly described as a feature. All integrations are read-only unless otherwise stated.

Third-party platforms may change their APIs, revoke access, or modify their data structures. We are not responsible for interruptions to integrations caused by third-party platform changes.

8. Intellectual Property

Lumen, its visual identity, the mark, the wordmark, and all associated intellectual property are owned by Ocularity Analytics Private Limited. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements.

Your business data remains your property at all times. By connecting your platforms to Lumen, you grant us a limited, non-exclusive licence to access and process that data solely for the purpose of providing the Lumen service to you. We do not claim ownership of your data, and we do not sell or share it with third parties for any purpose other than operating the service.

9. AI-Generated Responses

Lumen uses large language models to generate responses to your questions. While we design the system to be accurate and to ground responses in your actual data, AI systems can make errors. Lumen’s responses should be used as a tool to inform decisions, not as a substitute for professional financial, legal, or business advice.

We do not warrant that any response provided by Lumen is complete, accurate, or current. You should independently verify any information before acting on it, particularly for significant business decisions.

10. Disclaimer of Warranties

Lumen is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Ocularity Analytics shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Lumen. Our total liability to you for any claim arising from these Terms or your use of Lumen shall not exceed the total amounts paid by you to us in the three months preceding the claim.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Gurgaon, Haryana, India.

13. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes via email to the address associated with your account at least 14 days before the changes take effect. Your continued use of Lumen after the effective date of any change constitutes acceptance of the new Terms.
